Privacy Policy

This privacy policy governs your use of the Cleanlet software application (“Application”) created by Drexel University (“Drexel”).  The Application provides a new, meaningful opportunity for community participation in stormwater infrastructure management by crowd-sourcing and incentivizing the cleaning of storm drains for the public good and green infrastructure (GI) inlets in advance of forecasted precipitation events (Project).

Your Consent

By using the Application, you are consenting to our processing of User Provided and Automatically Collected information as further defined and as set forth in this Privacy Policy now and as amended in the future by us. “Processing,” means using cookies on a computer/handheld device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the U.S. your information will be transferred to the U.S. and processed and stored there under U.S. privacy standards. By using the website and providing information to us, you consent to such transfer to, and processing in, the U.S.

What information does the Application obtain and how is it used?

The Application collects certain information described below in connection with the Project.  The Project Team (“Project Team”) which includes the Project’s principal investigator, Drexel’s Franco Montalto, will only collect/use/share this information in compliance with this privacy policy and any applicable laws.

“Automatically Collected Information” – The Application collects technical information about your device and use of the Application when you log into it. Information such as your device’s operating system, the version of the Application, and the frequency the Application is accessed/used is collected by the Application and may be used to analyze and improve the quality of the Application.

“User Provided Information” – The Application obtains the information you enter into it voluntarily when you download the Application and log into the account that is created for you as part of your Project participation. When you log into the Application, you may be asked to provide contact or other identifying information such as username, email, password, and/or phone number, (a) your username, email address, sms/push message preference, password and other information you would like to share with the Application such as your survey responses; (b) information you provide us when you contact us for help. We may also use the information you provided us to contact you from time to time to provide you with important information, and required notices.

We will share your information with third parties only in the ways that are described in this privacy statement.

The Project Team reserves the right to use and disclose your User Provided and Automatically Collected Information:  as required by law (such as to comply with a subpoena, or similar legal process); when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request; to our third party service providers who work on behalf of the Project Team and do not have independent use of the information we disclose to them and have agreed to adhere to the rules set forth in this privacy policy.

Data Retention Policy, Managing Your Information

You may stop participating in the Project at any time, please note, that if you withdraw from the Project, you will no longer be able to use the Application. If you withdraw from the Project the Project Team will retain the information about you that was collected in the Application prior to your withdrawal to assure the integrity of the results. Any User Provided data that is retained by the Project Team will be used/disclosed in accordance with this Privacy Policy.

If you’d like us to delete User Provided Data that you have provided via the Application, please contact us at swre@drexel.edu and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly, and we may be required to retain certain information by law.  Following a deletion request, we will make a best effort to remove personally identifiable information, but activity records must be retained for the validity of the study.

Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should immediately contact us at swre@drexel.edu. We will delete such information from our files as soon as reasonably practicable.

Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy in the Application. You are advised to consult this Privacy Policy regularly for any changes.

Terms of Service

The Cleanlet software application (also referred to herein as “Cleanlet” or “the Application”) was created by Drexel University. The Application provides a new, meaningful opportunity for community participation in stormwater infrastructure management by crowd-sourcing and incentivizing the cleaning of storm drains for the public good and green infrastructure (GI) inlets in advance of forecasted precipitation events (Project). The Project’s principal investigator is Dr. Franco Montalto (“Project Team”).

To that end, we provide you with these terms of service to advise you of the legal obligations you assume when you engage with the Application or use the services provided on the Application. These terms govern the use of the Application.

To the extent you are accessing or using the Cleanlet Application on behalf of an individual, company or team, including without limitation by registering for an account on behalf of an individual or team, your use of the Cleanlet application is governed by the Cleanlet Application Terms.

1. The Cleanlet Application Terms

Please read these Cleanlet Terms carefully before accessing or using the Application. These Cleanlet Terms constitute an agreement between Drexel University and you and governs your permitted use of the Cleanlet Application. By accessing or using the Application in any manner, including without limitation by downloading or using the Cleanlet Application or registering for an account on the Application, you affirm that you have read, understand, and agree to be bound by these Cleanlet Terms, as well as the Cleanlet Privacy Policy. Drexel reserves the right, at its discretion, to modify these Cleanlet Terms at any time by posting revised Cleanlet Terms in the Cleanlet Application and by providing notice via e-mail, where possible. You shall be responsible for reviewing and becoming familiar with any such modifications. Your access to or use of the Application following such modification constitutes your acceptance of the terms and conditions of these Cleanlet Terms as modified.

PLEASE BE AWARE THAT BY USING THE APPLICATION, EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE SECTION TITLED “MANDATORY ARBITRATION” BELOW, YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND DREXEL UNIVERSITY WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

2. Contracts are Binding and Legally Enforceable

As stated above, these Cleanlet Terms constitute an agreement between Drexel and you and governs your use of the app. These Cleanlet Terms do NOT govern the use of any of our other websites or services that are not part of the Cleanlet Application. In the event of any conflict between these Cleanlet Terms and any such service or licensing agreements, these Terms shall prevail.

3. Access to the Application

The Project Team will use reasonable efforts to make the Application available 24/7/365, but from time-to-time we will have scheduled outages for maintenance purposes and other upkeep. Where feasible, we may, in our sole discretion, make efforts to inform you about any outages and report on the nature and reason for any outages that may occur in an open and transparent manner, though we are under no obligation to do so, and in any case will not be liable for any downtime.

4. User Obligations

    • To access the Application you will need to register for an account as an individual and consent to these Cleanlet Terms. If you do not consent to these Cleanlet Terms, you may not download or use the Cleanlet application. The Project Team reserves the right to refuse, suspend or terminate your access to the Application for any lawful reason.

    • Please also review our Privacy Policy, which explains how we will handle, process, and use your personal data, and with whom, and how we will share this data.

5. Content Permissions and Restrictions

You hereby grant to Drexel University a non-exclusive, royalty free license to reproduce, distribute, display and create derivative works of any content you upload to the App.  You hereby represent and warrant that you own or have secured all necessary permissions to grant the aforementioned license such that it will not cause Drexel to infringe on the intellectual property rights of a third party.

6. Disclaimer of Warranties

TO THE MAXIMUM EXTENT ALLOWED BY LAW, THE PROJECT TEAM AND DREXEL UNIVERSITY DISCLAIM ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THE PROJECT TEAM AND DREXEL UNIVERSITY PROVIDES NO GUARANTEES THAT THE APPLICATION WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS AND PROVIDES THE SERVICES, AND ANY RELATED CONTENT OR PRODUCTS SUBJECT TO THESE CLEANLET TERMS ON AN “AS IS” BASIS.

8. Indemnification

You hereby indemnify and hold the Project Team, Drexel University, their employees, agents, research sponsors, consultants, contractors, partners, vendors and service providers (including, without limitation, hosting and telecommunications providers) harmless, including costs and attorneys’ fees, from any claim or demand made by any third party due to or arising out of your access to the Application, use of the Application or services made available on the Application, your violation of this Agreement,  your infringement of any intellectual property right, or any third party use of your account.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROJECT TEAM, DREXEL UNIVERSITY AND ITS AFFILIATES SHALL NOT BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE APPLICATION  OR SERVICES (I) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, REPUTATION, PROFITS OR REVENUES, OR (II) FOR ANY DIRECT DAMAGES IN EXCESS OF ONE HUNDRED DOLLARS ($100) IN THE AGGREGATE, EVEN IF THE RESEARCH TEAM, DREXEL UNIVERSITY OR THEIR AFFILIATES HAVE BEEN TOLD OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF THESE REMEDIES FAIL THEIR ESSENTIAL PURPOSE. NOTHING IN THIS LIMITATION OF LIABILITY SHALL PREVENT THE PROJECT TEAM OR DREXEL UNIVERSITY THE RIGHT TO SEEK AND OBTAIN EQUITABLE RELIEF. NOTWITHSTANDING SUCH RIGHT OF EQUITABLE RELIEF, TO THE EXTENT THAT APPLICABLE LAW DOES NOT PERMIT SUCH LIMITATION OF LIABILITY OR EXCLUSION OF LIABILITY, SUCH LIMITATION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. General Provisions

a. Assignment and Jurisdiction

The Drexel reserves the right to assign our rights and obligations under these Cleanlet Terms (in whole or in part) without your consent to a corporate affiliate, or in connection with a merger, acquisition, corporate restructure or reorganization, or due to the sale of all or substantially all of our assets.

b. Modifications

Drexel reserves the right, to modify or replace these Cleanlet Terms, for any reason or to change, suspend, or discontinue access to the Cleanlet Application any time by posting a notice. We will notify you of any changes to the Cleanlet Terms or the Cleanlet Application in the Cleanlet Application  by posting the Terms in the Application or by sending you notice via e-mail or by another appropriate means of electronic communication.

c. No Waiver

Our failure to enforce any part of these Cleanlet Terms shall not constitute a waiver of our right to later enforce that or any other part of these Cleanlet Terms. Waiver of compliance in any particular instance does not mean that we will waive compliance in the future. In order for any waiver of compliance with these Cleanlet Terms to be binding, we must provide you with written notice of such waiver through one of our authorized representatives.

d. Headings

The section and paragraph headings in these Cleanlet Terms are for convenience only and shall not affect their interpretation.
